1. Acceptance of Terms

By downloading, installing, or using DaBank ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

DaBank is operated by DaBank ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.

2. Description of Service

DaBank is a private utility app that allows you to save, organize, and share memes, GIFs, and images. The App includes a keyboard extension that lets you access your saved content directly from any messaging app. DaBank is not a social network — there are no public feeds, user profiles, or content discovery features.

3. User Accounts

You may be required to create an account to use certain features of the App. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account.

4. User Content and Responsibilities

You retain ownership of any content you save, upload, or store in DaBank. By using the App, you represent that:

• You have the right to save and use the content you store in DaBank
• Your content does not infringe on the intellectual property rights of any third party
• Your content does not violate any applicable laws or regulations

We do not monitor, review, or moderate the content you save in your private library. However, we reserve the right to remove content or terminate accounts that are reported for violating these Terms.

5. Prohibited Uses

You agree not to use DaBank to:

• Store, distribute, or share illegal content of any kind
• Store content that exploits or harms minors
• Infringe on the intellectual property rights of others
• Distribute malware, viruses, or harmful code
• Attempt to gain unauthorized access to the App, its servers, or other users' accounts
• Use the App for any commercial purpose not expressly permitted
• Reverse engineer, decompile, or disassemble the App
• Use automated systems or bots to access the App

6. Subscriptions and In-App Purchases

DaBank offers a one-time download purchase and optional subscription plans that provide additional storage for your meme library. By purchasing a subscription or in-app purchase, you agree to the following:

Billing

All purchases are processed through the Apple App Store or Google Play Store. We do not collect or store your payment information. Billing terms, payment methods, and transaction processing are governed by Apple or Google's respective terms.

Subscription Renewal

Subscriptions automatically renew at the end of each billing period (monthly) unless you cancel before the renewal date. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You can cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period. You will retain access to subscription features until the end of your paid period. We do not provide refunds for partial billing periods.

Price Changes

We reserve the right to change subscription pricing at any time. If prices change, we will notify you in advance. Continued use of the subscription after a price change constitutes acceptance of the new pricing.

7. Intellectual Property

The DaBank name, logo, design, and all original content within the App are the intellectual property of DaBank and are protected by applicable copyright, trademark, and other intellectual property laws. You may not use our branding, trademarks, or proprietary materials without prior written permission.

The App is licensed to you, not sold. This license does not grant you any rights to our intellectual property beyond what is necessary to use the App as intended.

8. Disclaimer of Warranties

DaBank is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. We make no warranties regarding the reliability, accuracy, or availability of the App.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, DaBank and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of content, arising out of or related to your use of the App.

Our total liability for any claim arising from your use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your access to DaBank at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may stop using DaBank at any time. If you wish to delete your account, you can do so within the App or by contacting us at support@dabank.app.

11. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of DaBank shall be resolved in the state or federal courts located in Texas.

12. Changes to These Terms

We may update these Terms of Use from time to time. When we do, we will revise the "Last updated" date at the top of this page. We encourage you to review these Terms periodically. Your continued use of DaBank after any changes to these Terms constitutes your acceptance of the updated Terms.
